NYC Residential Trash Bin Requirements and Building Compliance

SLK Buildings NYC Department of Sanitation (DSNY) Compliance & Filings

Identify the bin requirement for your building and make the storage and collection routine workable.

NYC residential trash bin requirements depend on the number of residential units, the collection arrangement and, for larger buildings, the district’s containerization rollout. Owners need those facts before choosing equipment or changing the building’s routine. A neighboring property can have different obligations even when both receive collection on the same day.

For properties with one to nine residential units receiving City collection, official NYC Bins have been required for trash since June 1, 2026. Full enforcement began September 8, 2026. A generic lidded trash can is therefore no longer the ordinary compliant substitute for a property in that category.

Start With the Building and Its Collection Service

Confirm the residential unit count, the building’s service arrangement and the current instructions issued for its district. For a mixed-use property, identify the commercial tenant’s waste separately. Keep any DSNY letters, bin assignments or approved exceptions in the property file, together with the contact responsible for implementing them.

The official NYC Bin requirement also applies to specified special-use properties receiving DSNY collection, including qualifying nonprofit premises, houses of worship and professional offices in residential buildings. Official recycling and compost bins are available, but the branded-bin requirement is for trash.

Provide Enough Capacity and a Usable Storage Area

Owners and managers are responsible for providing sufficient bins for their building’s trash. Choose quantities based on actual occupancy and the material generated between collections. The lid should close with the waste inside; a bin that is routinely overloaded does not solve the building’s capacity problem.

Review a complete collection cycle before buying additional containers. Count the material, note when the storage area becomes full and check how many containers staff can move safely along the route. Include the opening of doors and the space needed to retrieve a bin at the back. A group of containers that fits into a room may still be impractical if every pickup requires moving unrelated items.

Understand the Empire Bin Rollout

DSNY’s large-building program uses stationary Empire Bins assigned to individual properties. In implementing districts, buildings with at least 31 residential units use Empire Bins, while those with 10–30 units have a choice under the district’s registration process. The rollout is phased; these categories do not mean every large building citywide already has an active assignment.

As reviewed in October 2026, Manhattan Community District 9 was operating under the program and DSNY listed Brooklyn Community District 2 for a fall 2026 rollout. BK2’s registration and opt-in period closed July 31, 2026. An owner should confirm the address-specific assignment and current instructions rather than submit an expired form or assume another district’s start date applies.

For an assigned Empire Bin, record the access-card holder, staff backup and contact for service issues. Explain which container belongs to the property and where oversize items are handled. Review the cleaning responsibilities around the bin with the building team and report equipment or capacity problems through the DSNY service route.

Coordinate Setout and Sidewalk Access

Keep storage location, setout timing and container type as separate checks. A compliant bin still needs to be placed and returned at the correct times, and its location must preserve pedestrian passage. DSNY’s rules allow limited storage near the building line when other premises storage is unavailable, subject to keeping the sidewalk unobstructed. Sidewalk enclosures require separate DOT consideration. Residential properties using private carters follow the applicable commercial collection rules.

Map out the frontage before committing to a permanent enclosure. Note entrances, access points and the space used by residents and pedestrians. If the arrangement needs a physical alteration, bring the relevant professional and agency into the discussion while changes are still practical. Bin purchases alone do not resolve a constrained building layout.

Public Safety Hazard and Hardship Requests

The adopted residential container rule provides a temporary waiver request for a pedestrian public safety hazard or unreasonable hardship. The request must follow DSNY’s process, and the agency determines the outcome. A lack of convenient storage is not an automatic authorization to stop using required bins.

Prepare a factual record of the constraint, including measured space, the proposed container arrangement and alternatives considered. Explain the specific conflict rather than relying on a general statement that the building is small. Retain the agency determination and follow the conditions and duration of any relief granted.

How SLK Buildings Helps

SLK Buildings helps owners identify the relevant collection category, organize property and layout information and coordinate questions with DSNY. Where a waiver request or related agency review is appropriate, we can help prepare and track the submission. We also help keep bin decisions aligned with the building’s broader waste management and compliance work.

Frequently Asked Questions

Can a one-to-nine-unit building keep using ordinary trash cans?

For covered properties receiving City collection, the ordinary requirement is now official NYC Bins for trash. It began June 1, 2026, with full enforcement from September 8, 2026.

Must recycling and compost use branded NYC Bins?

No. Official branded bins are required for trash in covered properties. Recycling and compost can use other containers that meet the relevant material, labeling and lid requirements.

Does every building with 31 apartments already need Empire Bins?

No. The program rolls out by district. Confirm the building’s location, assignment and implementation instructions before applying the large-building category to an individual address.

Can residents use any Empire Bin on the block?

Empire Bins are assigned to specific buildings. Access is controlled through cards held by building staff and DSNY; they are not general public trash containers.

Is a waiver available if bins cannot fit?

A temporary waiver request may be available under the rule for specified safety or hardship grounds. DSNY must evaluate the facts. Document the constraint and use the agency’s current procedure.

What should a property manager review after changing bins?

Check capacity through a full collection cycle, staff access, labeling, setout instructions and return arrangements. Keep the current bin assignment or approval accessible to whoever covers the property when the usual manager is absent.
