CLASSIFICATION OF NYC ECB Violations
The Environmental Control Board (ECB), operating under Office of Administrative Trials and Hearings (OATH) issues violations for non-compliance with NYC’s Building Codes and Regulations.
Classification of Violations:
- Class 1 (Immediately Hazardous Violation)
- Class 2 (Major Violation)
- Class 3(Lesser Violation)
Class 1 (Immediately Hazardous Violation)
Immediately hazardous violations are those specified as such by the New York City Construction Codes, or those where the violating condition poses a threat that severely affects life, health, safety, property, the public interest, or a significant number of persons so as to warrant immediate corrective action, or, with respect to outdoor advertising, those where the violation and penalty are necessary as an economic disincentive to the continuation or the repetition of the violating condition. Immediately hazardous violations shall be denominated as Class 1 violations.
Examples include “Work Without Permit”, violations, Stop Work Orders Violations and Vacate Orders.
Class 2 (Major Violation)
Major violations are those specified as such by the New York City Construction Codes or those where the violating condition affects life, health, safety, property, or the public interest but does not require immediate corrective action, or, with respect to outdoor advertising, those where the violation and penalty are appropriate as an economic disincentive to the continuation or the repetition of the violating condition. Major violations shall be denominated as Class 2 violations.
Class 3 (Lesser Violation)
Lesser violations are those where the violating condition has a lesser effect than an immediately hazardous (Class 1) or major violation (Class 2) on life, health, safety, property, or the public interest. Lesser violations shall be denominated as Class 3 violations.

THE MOST COMMON NYC ECB VIOLATIONS
The most common NYC ECB violations with severe punishment are:
- Vacate Order: Beginning December 15, 2023, the Department of buildings imposed an additional civil penalty when a violation for a failure to obey a Vacate Order is issued. In addition to correcting the condition that resulted in the Vacate Order, the civil penalty must be paid before the Vacate Order is lifted. See NYC Administrative Code Section 28-207.4.3. The civil penalty for failure to obey a vacate order is $6,000 for the initial violation and $12,000 for every subsequent violation. When DOB issues a violation for failure to obey a Full or Partial Vacate Order to a property, the Vacate Order banner on the property’s DOB NOW Property Profile will include the civil penalty amount due.
