OATH Rescheduling and Adjournments ~ Changing a Hearing Date

SLK Buildings Office of Administrative Trials and Hearings (OATH) Appeals

OATH rescheduling and adjournments are two different procedures used when a New York City administrative hearing cannot continue on the original timetable. A reschedule request ordinarily happens before the hearing starts; an adjournment is considered during a hearing by a Hearing Officer.

Neither process should be treated as automatic permission to ignore an existing hearing date. A respondent should preserve the summons, confirm which procedure applies, submit the appropriate request on time, and retain the replacement notice or written order.

The Difference Between OATH Rescheduling and Adjournments

Rescheduling Before the Hearing

Under OATH Hearings Division Rule 6-05, either party may request a later hearing date, but a respondent’s request must be received before the scheduled hearing time. Good cause is not required for the ordinary pre-hearing request, and no more than one pre-hearing reschedule is granted to each party for each summons. That is different from a request made during a hearing. Requests involving OATH rescheduling and adjournments should identify whether the hearing has not yet begun or whether the Hearing Officer has already taken up the case.

Adjournment During a Hearing

Rule 6-14 permits a Hearing Officer to adjourn a hearing on a showing of good cause, considering fairness, witness availability, earlier adjournments, and the parties’ preparation opportunities. The Hearing Officer decides the request under the rule. A party cannot assume it will be granted merely because a contractor or witness is unavailable.

How to Request an OATH Hearing Reschedule

  • Confirm the original date and time ~ Check the summons and any prior official notices; identify the relevant summons numbers.
  • Use an approved channel ~ OATH offers a request form online and a mail procedure. A mailed request must be received before the scheduled hearing.
  • Provide accurate respondent information ~ Match the name and case number on the ticket and provide a reliable mailing address for the new notice.
  • Check representative authorization ~ Anyone submitting on behalf of a named respondent must satisfy the applicable authorization requirements.
  • Keep a confirmation record ~ Save the completed request and any receipt, but do not assume that submission alone means a new date was approved.

What If OATH Has Already Rescheduled the Case?

The ordinary pre-hearing rescheduling rule has a one-request limit for each party and summons. Review the new hearing notice carefully rather than submitting repetitive requests. Separate summonses may have different dates and dispositions, even when they arose from the same property inspection.

If OATH grants a reschedule, keep the new hearing notice with the original ticket. Update any client calendar, representative schedule, site access plans, and evidence delivery plan. If the portal and notice appear inconsistent, contact OATH before taking a procedural risk. For OATH rescheduling and adjournments, keep every revised notice and order with its issuance date so the next appearance and any document deadline remain clear.

How SLK Buildings Helps Track OATH Hearing Dates

SLK Buildings can maintain a case timeline and organize summonses, notices, and records for project participants. We can also identify which agency or qualified professional should address separate compliance deadlines. It cannot approve an adjournment or guarantee that OATH will accept a particular request.

How to Respond to an Adjournment Order

An adjournment order may ask for further documents, proof of authorization, or another response by a specific date. OATH has a dedicated online form for responding to certain adjournment orders issued after online or mail submissions. The form must be received by the date on the order; do not substitute the original summons deadline.

Read the order word for word. Identify precisely what the Hearing Officer requested, who must provide it, whether the order covers more than one summons, and how the response should be submitted. Keep both the order and proof of the response.

Rescheduling Is Not the Same as Reopening a Default

Once a hearing has been missed and a default issued, the ordinary rescheduling procedure is generally no longer the correct route. A default reopening request is a separate motion with its own dates and rules. See OATH Default Decisions rather than treating a late reschedule form as a remedy.

Effects on Agency Correction and Settlement Deadlines

A changed OATH hearing date does not automatically extend a DOB cure date, FDNY deadline, or another enforcement agency’s required correction schedule. Read the agency’s written instructions and ask that agency about its own deadlines. See OATH Settlements and Cures and OATH Agency Coordination. OATH rescheduling and adjournments do not themselves extend the separate cure or compliance dates set by an issuing enforcement agency.

Frequent Errors with OATH Rescheduling

Common errors include requesting a change after the hearing, assuming a filed request automatically postpones the case, and overlooking a previously used reschedule opportunity. An adjournment order is also not a corrected summons. The most serious risk is allowing the scheduled date to pass without an authorized hearing response.

🚧 Seeking Professional Guidance on NYC OATH Hearings, Summonses, and Violation Compliance

An OATH summons from a New York City enforcement agency may require action by a stated hearing date. Owners and managers should identify the named respondent, alleged violations, issuing agency, and case records. OATH conducts hearings, while the issuing agency retains enforcement and correction responsibilities.
OATH hearings may relate to DOB, DSNY, DOHMH, and other enforcement matters. Hearing options, eligible settlements and cures, default reopening, appeals, and payments have different requirements. Check the summons and issuing-agency instructions before choosing a response.

Frequently Asked Questions

Can I reschedule an OATH hearing once?

Generally, yes. OATH Rule 6-05 permits one pre-hearing reschedule request per party and summons, received before the hearing time.

Do I need to give a reason for my first pre-hearing reschedule?

The ordinary rescheduling rule does not require good cause. An adjournment requested during a hearing is a different matter and requires a showing of good cause.

Is my hearing moved as soon as I submit the form?

Do not assume so. Keep checking for OATH confirmation and follow existing instructions unless an authorized change is issued.

What if a Hearing Officer sends an adjournment order?

Follow the exact date and submission instructions in the order. Some orders can be answered using OATH’s dedicated online form.

Does a new OATH date also extend my DOB cure deadline?

Not automatically. Cure and correction obligations come from the issuing agency and may have separate deadlines.
